Terms of Service

1. Acceptance of Terms

By accessing or using FlameTech Solutions ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

FlameTech Solutions is operated by FlameTech Consulting Inc.

FlameTech Solutions is a field service management platform. Business accounts may participate in the promotional Essential offer under the conditions in Section 3.

2. Service Availability and Disclaimer

2.1 Service Changes

The Service continues to evolve. This means:

• The Service may contain bugs, errors, and incomplete features
• We may modify, suspend, or discontinue any aspect of the Service at any time
• The Service may experience interruptions
• Product descriptions do not guarantee that every future feature will be delivered

2.2 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

2.3 Data Retention

Your data remains subject to the Privacy Policy and these Terms:

• You are responsible for maintaining your own backups
• Ending promotional enrollment alone does not delete stored media
• Account closure, termination, legal requirements, and the retention policy may affect how long data is kept

3. Promotional Essential and Pricing Terms

3.1 Promotional and Paid Price

Essential has no FlameTech subscription fee for the first 12 months from business account creation. Beginning in month 13, Essential is $15 per location/month. That price is guaranteed through month 24, the first paid year. Cancel anytime. Charges from third-party providers, including payment processing or accounting services, are separate and remain subject to those providers’ terms.

3.2 Offer and Start Date

The offer is limited to one per business. The promotional period begins on the business account creation date.

3.3 Essential Features and Allowances

Essential includes the Service features advertised on the FlameTech website, 3 GB of total media storage allocated as 2 GB for Work Order media and 1 GB for reusable template media, and monthly allowances of 250 quotes, 250 invoices, 250 Work Reports and 1,000 emails.

3.4 Notification of Changes

If a change would reduce your storage allowance:

• You will receive at least 30 days’ advance notice via email or through the Service
• You may choose to accept the new terms or discontinue use
• Continued use after the notice period constitutes acceptance
• You may contact support to discuss available data options before any changes take effect

3.5 Offer Continuity

The end of an account’s 12-month free period does not affect its first paid-year price guarantee, and it does not by itself delete stored media. The Privacy Policy and ordinary retention terms continue to apply.

4. User Accounts and Responsibilities

4.1 Account Creation

To use the Service, you must:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Be at least 18 years old or have parental consent

4.2 Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Transmit malware, viruses, or malicious code
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Reverse engineer or attempt to extract source code

4.3 Data Ownership

You retain all rights to your data. By using the Service, you grant us a license to use, store, and process your data solely to provide the Service to you.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by FlameTech Consulting Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your use of the Service does not grant you any ownership rights to our intellectual property.

6. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

We may collect diagnostic and usage data to improve the Service as described in the Privacy Policy.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• WE SHALL NOT BE LIABLE FOR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL
• OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD
• THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.

8. Indemnification

You agree to defend, indemnify, and hold harmless FlameTech Consulting Inc., its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

• Your use of and access to the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the Service

9. Termination

You may cancel your FlameTech subscription at any time. Account closure and data retention remain subject to these Terms and the Privacy Policy.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• If we discontinue the Service
• At our sole discretion

Upon termination, your right to use the Service will immediately cease. We are not obligated to maintain or provide your data after termination.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If we make material changes, we will notify you via email or through the Service at least 30 days before the changes take effect.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of competent jurisdiction.
